Introduction

Gloho Inc. and/or its affiliates ("Gloho") Gloho operates the following Websites: gloho.com, pro.gloho.com ubicala.co, ubicalapro.com, propdetail.com, detalleinmueble.com across desktop, notebooks, mobile, tablet and apps, including any other domain and subdomain operated directly from us, collectively known as the “Website(s)” or Site(s) in this Privacy Policy

This Privacy Policy sets out the manner in which we collect, use, manage and disclose personal information. By using our Websites, subscribing to our Gloho Services or entering into an agreement with us, you are taken to have read, and agreed to the collection, use, handling and disclosure of your personal information in accordance with this Privacy Policy.

If you see an undefined term in this Privacy Policy (such as "Ad", "Advertiser", “Gloho Services",), it has the same definition as outlined in our Conditions of Use. When this Policy mentions “Gloho”, “company”, “we”, “us”, “our(s)”, (and other variations included) it refers to Gloho company that is responsible for your information under this Privacy Policy (the "Data Controller").

Information we collect

There are three general categories of information we collect.

  1. Information you give us

    We collect information you share with us when you use our Websites

    1. Account information. When you sign up for an account in our Websites or purchase our products, we may require certain information such as your name, email address, date of birth among others.
    2. Profile information. To use certain features within our Websites, we may also ask you to complete a profile, which may include your address, phone number, and gender. Certain parts of your profile (like your profile picture, name, description, logo, company name) are a part of your public profile page and will be publicly visible to others.
    3. Other authentication related Information. To help create and maintain a trusted environment, we may collect identification (like a photo of your government-issued ID) or other authentication information.
    4. Payment information. We collect your financial information (like your bank account or credit card information) when you use the payment services to process payments.
    5. Communications with Websites and other Advertisers and visitors. When you communicate with Gloho or use our Websites to communicate with other Advertisers and visitors, we collect information about your communication and any information you choose to provide.
    6. Address Book Contact Information. You may choose to import your address book contacts or enter your contacts” information manually to access certain features of our Websites, like inviting them to use our sites, use email marketing or other features.
    7. Other Information. You may otherwise choose to provide us information when you fill in a form, conduct a search, update or add information to your Gloho account, respond to surveys, post to community forums, participate in promotions, or use other features of our Websites.
    8. If you send us personal information in connection with an employment opportunity, we may also collect information about your employment history and your academic record.
  2. Information we automatically collect from your use of our websites

    When you use our Websites, we collect information about the services you use and how you use them.

    1. Usage information. We collect information about your interactions with our Websites, such as the pages or other content you view, your searches for Ads, alerts, call to actions you make, and other actions on our sites.
    2. Location information. When you use certain features of our Websites, we may collect different types of information about your general location (e.g. IP address, zip code) or more specific location information (e.g. precise location from your mobile GPS). Most mobile devices allow you to control or disable the use of location services for applications in the device”s settings menu.
    3. Log data. We automatically collect log information when you use our Websites, even if you have not created an account or logged in. That information includes, among other things: details about how you”ve used the Websites (including links to third party applications), IP address, access times, hardware and software information, device information, device event information (e.g., crashes, browser type), and the page you”ve viewed or engaged with before or after using the Websites.
    4. Transaction information. We collect information related to your transactions on the Websites, including the date and time, amounts charged, and other related transaction details.
  3. Information we collect from third parties

    We may collect information that others provide about you when they use our Websites, or obtain information from other sources and combine that with information we collect through our Websites.

    1. Third party services. If you link, connect, or login to your account with a third party service (E.g., Facebook, WeChat), the third party service may send us information such as your registration and profile information from that service. This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.
    2. Background information. For Advertisers and visitors to the extent permitted by applicable laws, Gloho may obtain reports from public background records or crime listings. We may use your information, including your full name and date of birth, to obtain such reports.
    3. Other sources. To the extent permitted by applicable law, we may receive additional information about you, such as demographic data or fraud detection information, from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from service providers like identity verification services for our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off our Websites through partnerships, or about your experiences and interactions from our partner ad networks.

How we collect your personal information

We may collect, store and process information about you to provide, understand, improve, and develop our Gloho Services, and to create and maintain a trusted and safer environment.

Provide, Improve, and develop our Gloho Services

  1. Enable you to access and use our Websites, or parts of them through your account;
  2. Enable you to communicate with other Advertisers and visitors;
  3. Logging in to use our Websites via your social networking site (“SNS“) account;
  4. Subscribing to receive Alerts/e-brochures and filling in forms, applications, surveys or research, participating in promotions and competitions on the Websites or websites of our service providers;
  5. Operate, protect, improve and optimize our Gloho Services and experience, such as by performing analytics and conducting research;
  6. Customize your experience by, among other things, ranking search results or showing ads based on your search, booking history, and preferences;
  7. Enable you to access and use the payment services;
  8. Contacting us or our service providers for any reason including, but not limited to, reporting a problem with the Websites, requesting further services or seeking our assistance;
  9. Posting or contributing material on our Website;
  10. Send you service or support messages, such as updates, security alerts, and account notifications; payment and financial information about you (such as bank account or credit card information) each time you use the payment services to process your payments with us;
  11. Payment and financial information about you (such as bank account or credit card information) each time you use the payment services to process your payments with us.
  12. Using our Gloho Services and any credit provided by us in connection with those services (see our Credit Reporting Policy below for more detail);
  13. Applying for an employment opportunity with us directly, via an SNS site (E.g. LinkedIn) or through your nominated referees;
  14. If you provide us with your contacts” information, we may use and store this information: (i) to facilitate your referral invitations, (ii) send your requests for references, (iii) for fraud detection and prevention, and (iv) for any purpose you authorize at the time of collection.

Create and maintain a trusted and safer environment

  1. Detect and prevent fraud, spam, abuse, security incidents, and other harmful activity;
  2. Conduct investigations and risk assessments;
  3. Verify or authenticate registered information or identifications provided by you (such as compare your identification photo to another photo you provide);
  4. Conduct checks against databases and other information sources;
  5. Comply with our legal obligations;
  6. Resolve any disputes with any of our visitors and enforce our agreements with third parties;
  7. Enforce our Privacy Policy, Conditions of Use and all other documents directly or indirectly related to them.

Provide, personalize, measure, and improve our advertising and marketing

  1. Send you promotional messages, marketing, advertising, and other information that may be of interest to you based on your communication preferences (including information about our Gloho Services or partner campaigns and services);
  2. Personalize, measure, and improve advertising;
  3. Share your information with our service providers and other third parties so that they can provide you with products or services on our behalf or help us to provide you with the requested products or services including contacting you in relation to the products or services;
  4. Share your personal information with other third parties so that they can contact information about offers, promotions, products or services, which we believe may be of interest to you.

We may also collect your personal information through our corporate related bodies, our service providers and third parties so that we may provide a better or more relevant service or product to you.

If you apply to us for credit, we may also obtain personal information about you from credit reporting agencies (see our Credit Reporting Policy below), other credit providers, existing or previous suppliers of goods or services, your bank and certain other businesses for the purposes of assessing your application.

How we use your personal information

We use the personal information we have collected largely for the purpose of providing you with the Gloho Services that you have requested, responding to your inquiries, creating and maintaining your account and ensuring you comply and adhere to our Websites Conditions of Use and all other documents directly or indirectly related to them. More specifically, Gloho may use personal information which it has collected to:

  1. Ensure that content from the Websites is presented in the most effective manner for you and for your computer;
  2. Provide a better or more relevant Gloho Services to you, for instance by automatically populating forms on our Websites when you make enquiries of selected Advertisers and Ads;
  3. Combine your personal information with information that our Websites have collected from its service providers, third parties, cookies or web beacons in order to provide you with a better or more relevant and personalized experience and to improve the quality of its services and the services of third parties. For example, we may combine behavioral data we have collected about you through the use of cookies or web beacons and combine it with your personal information from requests you send to third parties through our website;
  4. Personalize and customize your Gloho Services, experience, advertising and content that you view and engage with on our Websites or the websites of our service providers and business partners:
  5. Respond to or provide you with service, products, information and assistance that you request from our Websites;
  6. Contact you to conduct surveys, research and feedback about our Gloho Services or our Websites;
  7. Verify your identity when you register or log into our Websites via your SNS account and remind you of your password and username;
  8. Allow you to participate in interactive features of our service, when you choose to do so;
  9. Carry out our obligations arising from any contract entered between you and us;
  10. To assess your application for credit as a business in connection with our services;
  11. By disclosing the information to debt collection agencies to recover any amounts you owe us; and
  12. Notify you about changes to our Gloho Services.

If all or part of this information is not provided, we may not be able to provide our Gloho Services.

If you submit personal information to us in relation to an employment opportunity with us, we may also use your personal information to:

  1. Consider you for the position for which you have submitted your personal information to us or any other positions that are or become available in the future;
  2. Respond to you in relation to any future application you make for an employment opportunity with us; and
  3. Contact your referees in order to collect the information you have consented to us collecting about you in order to consider you for employment opportunities with us.

How we disclose your personal information

We may disclose personal information to our corporate related bodies, service providers or business partners. We may also disclose your personal information:

  1. To Advertisers and visitors of our Websites and Gloho Services that have requested information by submitting an enquiry;
  2. To our service providers, so that they can provide you with products or services on our behalf or products or services that you have requested directly from them or to help us to provide you with our Gloho Services. If you have subscribed to a service through the operating system on your mobile device (including, but not limited to Google”s “Google Now” service), we will disclose information such as your search history to Google. You can opt out of us providing such information to Google through the operating system on your mobile device;
  3. To third parties where you have requested information, services or products from them;
  4. In conjunction with a real estate transaction or similar transfer of a business;
  5. If you apply to us for credit, to:

    (i) credit reporting agencies (for the purpose of obtaining credit reporting information about you and other permitted purposes – see our Credit Reporting Policy below); and (ii) other credit providers, existing or previous suppliers of goods or services, your bank and certain other businesses for the purposes of assessing your application;

  6. Relevant public, government or regulatory authorities, our legal representatives or other concerned parties, in special situations where we have reason to believe that disclosing your personal information is necessary to help identify, contact or bring legal action against anyone damaging, injuring, or interfering (intentionally or unintentionally) with our rights or property, visitors or anyone else who could be harmed by such activities; and
  7. Where we are otherwise authorized or required by law to do so.

If you request information from any organization through our Websites, you will need to check their privacy policy to find out how they handle your personal information. We are not responsible for the way these organizations collect, use, disclose or handle personal information you provide to them through the Websites.

Service providers

We use a variety of third party service providers to help us provide services related to our Gloho Services. Service providers may be located inside or outside of United States (E.g. America, Europa o Asia). For example, service providers may help us: (i) verify or authenticate your identification, (ii) check information against public databases, (iii) assist us with background checks, fraud prevention, and risk assessment, or (iv) provide customer service, advertising, or payments services. These providers have limited access to your information to perform these tasks on our behalf, and are contractually obligated to use it consistent with this Privacy Policy.

Safety and compliance with law

Gloho may disclose your information to courts, law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required to do so by law or if such disclosure is reasonably necessary: (i) to comply with legal process and to respond to claims asserted against Gloho, (ii) to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our visitors to legal liability, (iii) to enforce and administer our Conditions of Use and all other documents directly or indirectly related to them, with Advertisers and visitors, (iv) for fraud investigation and prevention, risk assessment, customer support, product development and debugging purposes, or (v) to protect the rights, property or personal safety of Gloho, its employees, its Advertisers, or members of the public.

We will attempt to notify Advertisers and visitors about these requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon Gloho”s property, its Advertisers and our Gloho Services (collectively, “Risk Scenarios”). In instances where we comply with legal requests without notice for these reasons, we will attempt to notify to Advertisers or visitors about the request after the fact if we determine in good faith that we are no longer legally prohibited from doing so and that no Risk Scenarios apply.

Corporate affiliates

To help us provide our Gloho Services, we may share your information within our corporate family of companies (both financial and non-financial entities) that are related by common ownership or control. These related entities are covered under this Privacy Policy, and when services have additional terms specific to them, we tell you through our Websites.

Cookies and web beacons

We use cookies, web beacons and measurement software and tools on our Websites and so do our services providers and third parties such as our analytics, advertising or ad serving partners. We use and disclose the information collected through the use of cookies, web beacons and measurement software and tools in accordance with this Privacy Policy. This includes using the information to report statistics, analyze trends, administer our services, diagnose problems and target and improve the quality of our products and services. We may allow other third parties to use their own cookies and web beacons to collect information about your visits to our Websites. We may combine our cookies, information collected through the cookies and web beacons on our Websites with other information (including information collected by third parties using their own cookies and web beacons and providing our cookies and information to third parties) and use analytics services such as Firebase Analytics – to provide better or more relevant services and advertising to you on the Websites and third party websites. Our service providers and other third parties may do the same in order to provide more relevant services and advertising to you through other websites that you may visit.

Cookies choices

If you do not want information collected through the use of cookies, web beacons or measurement software and tools, you may be able to delete or reject cookies or some of the measurement software features through your browser or the settings section of your mobile or tablet device. Disabling these features may cause some of the functions on our Websites and Gloho Services not to work properly.

Applications, widgets or links to other websites

We provide links to websites outside of our Websites, as well as to third party websites. We also allow some third parties to display widgets and applications on our Websites that allow you to interact and share content through social media buttons (E.g. share, like, among others) from diverse social media networks such as Facebook, Instagram, Twitter, Pinterest and Google+ among others. These linked sites, applications and widgets are not under our control, and we cannot accept responsibility for the conduct of companies linked to our Websites, or their collection of information through these third party applications or widgets. Before disclosing your personal information on any other website, or using these applications or widgets we advise you to examine the terms and conditions of using that website and the relevant third party”s data collection practices and controls in their privacy policy.

Business Transfer

If Gloho undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer or share some or all of our assets, including your information. In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

Aggregated data

We may also share aggregated information (information about our Advertisers and visitors that we combine together so that it no longer identifies or references an individual visitor) and non-personally identifiable information for industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

Other important information

Analyzing your communications

We may review, scan, or analyze your communications on our Websites for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, and customer support purposes. For example, as part of our fraud prevention efforts, we scan and analyze messages to mask contact information and references to other websites. In some cases, we may also scan, review, or analyze messages to debug, improve, and expand product offerings. We use automated methods where reasonably possible. However, occasionally we may need to manually review some communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyze your communications to send third party marketing messages to you, and we will not sell reviews or analyses of these communications.

Special Messaging Consent

By submitting a request or inquiry about (or a request or inquiry for information about), or a request or authorization to be contacted about any listing data, or home-related product, service, offering, procedures, detail or matters you are providing to Gloho”s Advertisers, visitors or service providers, your consent to be contacted for marketing, informational and related purposes in connection with such request, authorization or inquiry by one or more Advertisers, service providers or visitors and by Gloho by telephone device (including, but not limited to, being contacted on a recorded line and potentially by use of automated dialing systems and artificial or prerecorded voice messaging), email, mail or otherwise, based on the phone number, email address and/or other data you have provided. This consent applies even if your phone number, email address or other data is on a corporate, federal, state, local or other do-not-contact type of list or directory (such as the U.S. National Do Not Call Registry). You are not required to consent to receiving autodialer calls, or to otherwise provide this consent, as a condition of purchasing any products or services from Advertisers, service providers, visitors or Gloho. You agree that your submitted request, authorization or inquiry (as described above) acts as your electronic signature for this consent. You acknowledge that for text, SMS, calls and other electronic messages that message and data rates (for example, from your network provider) may apply. When sharing Personal Information in accordance with this Privacy Policy, we may also share your computer”s Internet Protocol (IP) address, identification number or location.

You (whether you are a visitor, an Advertiser, service provider or otherwise) consent to Gloho (including any designee of Gloho) contacting you in any manner consistent with information (including Personal Information) you have provided or we otherwise have pertaining to you or consistent with other instructions, requests, inquiries or consents that have been given by you or on your behalf (whether by way of this Privacy Policy or otherwise). If for a particular contact we determine we need consent from you we currently do not have (or are not sure we have), Gloho (including any designee of Gloho) may contact you by any available communication means to seek such consent. Gloho is not restricted as to information, including Personal Information, except as described in this Privacy Policy.

Link third party accounts

You may link your account in our websites with your account at a third party social networking service. Your contacts on these third party services are referred to as “Friends.” When you create this link:

  1. Some of the information you provide to us from the linking of your accounts may be published on your account profile in our Website;
  2. Your activities on our Websites may be displayed to your Friends on our Websites and/or that third party site;
  3. A link to your public profile on that third party social networking service may be included in our Websites public profile;
  4. Other visitors of our Websites may be able to see any common Friends that you may have with them, or that you are a Friend of their Friend if applicable;
  5. Other visitors of our Websites may be able to see any schools, hometowns or other groups you have in common with them as listed on your linked social networking service;
  6. The information you provide to us from the linking of your accounts may be stored, processed and transmitted for fraud prevention and risk assessment purposes; and
  7. The publication and display of information that you provide to Gloho through this linkage is subject to your settings and authorizations on our Websites and the third party site.

Google Maps/Google Earth

Parts of our Gloho Services use Google Maps/Earth services, including the Google Maps API(s). Use of Google Maps/Earth is subject to Google Maps/Earth Additional Terms of Use and the Google Privacy Policy.

Policies, modifications, and severability

Gloho works constantly to improve our Gloho Services, so we update our Conditions, Terms and Policies along with the Gloho Services. We reserved the right to make changes at any time and without notice to you, so please regularly review the most current versions by clicking their hypertext links located at the bottom of our sites. If any clause shall be deemed invalid, void, or for any reason unenforceable, that clause shall be deemed severable and shall not affect the validity and enforceability of any remaining clause.

Disclosure and storage of personal information abroad

Personal information submitted by Gloho Advertisers and visitors of our Websites may be held on servers located in United States, America, Europe and Asia, or in the data centers of Gloho outsourced data processors with data centers in the United States, America, Europe and Asia. We transfer personal data abroad to our service providers in order to obtain secure storage, back-up and data retrieval services and to provide services. Gloho has implemented policies and procedures to safeguard the secure storage and processing of data with its related companies and has verified the security arrangements of its outsourced data processors. When you provide us with your personal information you give us your consent to store your personal information abroad for the purposes described above. Where we have obtained your consent to do so, we may also share your personal information with our service providers and other third parties located abroad so that they can provide you with any product or service requested by you, including contacting you in relation to the products or services. As these entities are located abroad, they are not required to comply with the Privacy Policy and you will not be able to seek any redress under the Privacy Policy in connection with the use of your information.

Security

We strive to ensure the security, integrity and privacy of personal information we collect. We have established safeguards and use reasonable security measures to protect your personal information from unauthorized access, modification and disclosure. Our employees, contractors, agents and service providers who provide services related to our information systems, are obliged to respect the confidentiality of any personal information held by us. We review and update our security measures in light of current technologies. Unfortunately, no data transmission over the internet can be guaranteed to be totally secure.

Correction and access

We will endeavor to take all reasonable steps to keep accurate and up to date, any information which we hold about you. If, at any time, you discover that information held about you is incorrect or you would like to review and confirm the accuracy of your personal information, you can contact us here.

Complains resolution

Gloho is committed to providing its customers with a fair and responsible system for the handling of complaints. If at any time you have any concerns, complaints or questions in relation to your privacy or the operation of Gloho, please contact us here, so that we may resolve your concerns.

Credit Card

As long as you have an outstanding balance with us, you”ll provide us with valid credit card information and authorize us to deduct the monthly charges against that credit card. You”ll replace the information for any credit card that expires with information for a valid one. Anyone using a credit card represents and warrants that they are authorized to use that credit card, and that any and all charges may be billed to that credit card and won”t be rejected. If we”re unable to process your credit card order, we”ll try to contact you by email and suspend your account in our Websites until your payment can be processed.

Credit Reporting Policy

Credit applications by businesses for our Gloho services

Gloho provides “commercial credit” to Advertisers who apply for credit in relation to our Gloho services. We do not provide any consumer credit.

References to “you” and “your” in this credit reporting policy are references to individuals or companies in relation to whom we hold credit information or credit eligibility information for the purposes of the Privacy Act in connection with such credit. This policy provides details about our management of such information.

How we collect and hold “credit information” and “credit eligibility information” about you

“Credit information” relates mainly to your credit-related dealings with us and comprises various types of information that can be collected by credit reporting agencies that report on consumer credit worthiness. We may collect or generate various categories of “credit information” about you.

We may also collect “credit eligibility information” about you, which is mostly information provided by credit reporting agencies relating to your dealings with other credit providers (for example, financial institutions that provide you with loans or other businesses that provide you with credit in connection with their products or services).

“Credit information” and “credit eligibility information” may include:

  1. Identification information: such as your name, address, date of birth or employer;
  2. Consumer credit liability information: being information about consumer credit accounts you hold with other credit providers;
  3. Details about information requests made to credit reporting: such as the fact that we or another credit provider have requested credit reporting information about you from a credit reporting agency to assess a credit application and various details about the credit you have applied for;
  4. Default information: being information about overdue payments owed by you in connection with consumer credit which have been disclosed to a credit reporting agency by other credit providers;
  5. Payment information: being information that an overdue payment has been repaid;
  6. Information about consumer credit-related serious credit infringements;
  7. New arrangement information: being information about certain credit-related arrangements you may have entered with another credit provider in connection with a consumer credit default or serious credit infringement;
  8. Court proceedings information: being information about certain credit-related judgments;
  9. Personal insolvency information: being information about bankruptcy or various other insolvency-related matters;
  10. Publicly available information about activities relating to credit worthiness.

Credit eligibility also includes credit worthiness information that we may derive from data we receive from a credit reporting agency, such as a credit risk score.

We may collect credit information about you in any of the circumstances described above under the heading “How we collect your personal information” above. We collect credit eligibility information from credit reporting agencies but may collect it from other third parties where permitted by the Privacy Act (such as from other credit providers with your consent). We store and safeguard your credit information and credit eligibility information in the manner described under the headings “Disclosure and storage of personal information abroad” and “Security” above.

How we use and when we disclose your credit information and credit eligibility information

We may disclose your credit information to credit reporting agencies. Those credit reporting agencies may then include that information in credit reporting information that they provide to other credit providers to assist them to assess your credit worthiness. For example, we may disclose to a credit reporting agency the type of commercial credit, and the amount of credit, sought in your application for credit with us. We may also use and disclose your credit information for other purposes and in other circumstances as described under the headings “How we use your personal information” and “How we disclose your personal information” above when permitted to do so by the Privacy Act. We will only use or disclose such information for purposes permitted by these provisions, such as:

  1. To process an application for credit with us in relation to our Gloho services;
  2. To manage the commercial credit we provide and collect overdue payments; or
  3. Where a disclosure is required or authorized under the law or a court/tribunal order.

In some cases, the people to whom we may disclose your credit information or credit eligibility information may be based abroad – see the heading “Disclosure and storage of personal information abroad” above for more details.

Complaints regarding our compliance with credit reporting requirements

If at any time you would like to make a complaint about whether we have complied with the Privacy Act please contact our Privacy Officer here, so that we may resolve your concerns. If you make such a complaint, we will write to you with 15 days acknowledging that we have received your complaint and setting out how we will deal with it. We will aim to investigate and resolve your complaint within 30 days. We may need to consult with a credit reporting agency or another credit provider to do so. If we need more than 30 days to resolve your complaint, we will advise you of the reasons for the delay and ask for your consent to extend this day period.


E Consent

Gloho and its affiliates (“Gloho”) and third party service providers may need to provide you with certain communications, notices, agreements, billing statements, or disclosures in writing (“Communications”) regarding products or services (“Services”). Your agreement to this E-sign Consent confirms your ability and consent to receive Communications electronically from Gloho, its affiliates, and its third-party service providers, rather than in paper form, and to the use of electronic signatures in our relationship with you (“Consent”). If you choose not to agree to this Consent or you withdraw your consent, you may be restricted from using the Services.

Electronic delivery of communications and use of electronic signatures

Under this Consent, Gloho may provide all Communications electronically by email, by text message, or by making them accessible via our Gloho Services or our Websites. Communications include, but are not limited to, (1) agreements and policies required to use Gloho Services (E.g. this Consent, Conditions of Use, Privacy Policy, Customer Terms of Service, other binding documents directly or indirectly related to them, and any changes to any of them), (2) payment authorizations and transaction receipts or confirmations, (3) account statements and history, (4) Customer service communications, (5) and all federal and state tax statements and documents. We may also use electronic signatures and obtain them from you.

Hardware and software requirements

To access and retain the electronic Communications, you will need the following:

  • A computer or mobile device with Internet or mobile connectivity.
  • For desktop website-based Communications:
  • For application-based Communications:
    • A recent device operating system that supports text messaging, downloading, and applications from the Apple App Store or Google Play store; and
    • The most recent versions of Apple Safari or Google Chrome on iOS or Google Chrome for Android OS.
    • Access to the email address used to create an account for Gloho Services.
    • Sufficient storage space to save Communications and/or a printer to print them.
    • If you use a spam filter that blocks or re-routes emails from senders not listed in your email address book, you must add info@gloho.com to your email address book.

We may request that you respond to an email to demonstrate you are able to receive Communications.

Withdrawal of consent to electronic communications

You may withdraw your consent to receive Communications by writing to us at "Attn: E-Sign Consent”, here. However, withdrawal of your consent to receive electronic Communications may result in termination of your access to our Gloho Services. Any withdrawal of your consent will be effective after a reasonable period of time for processing your request, and Gloho will confirm your withdrawal of consent and its effective date in writing (either electronically or in paper form).

Paper delivery of communications

You may request a paper copy of Communications. To request a paper copy of any communication, contact us by writing to "Attn: E-Sign Consent, Gloho, Inc. 2202 8th Street, Unit 2712, Seattle, WA 98121", within 180 days of the date of the disclosure, specifying in detail the Communication you would like to receive. For the avoidance of doubt, requesting a paper copy of any Communication, in and of itself, will not be treated as withdrawal of consent to receive electronic Communications.

Updating your contact information

It is your responsibility to keep your primary email address current so that Gloho can communicate with you electronically. You understand and agree that if Gloho sends you a Communication but if you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, Gloho will be deemed to have provided the Communication to you; however, we may deem your account inactive. You may not be able to use our Gloho Services until we receive a primary valid and working email address from you.

Federal Law

You acknowledge and agree that your consent to electronic Communications is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act, and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.

Termination/Changes

We reserve the right, in our sole discretion, to discontinue the provision of your Communications, or to terminate or change the terms and conditions on which we provide Communications. We will provide you with notice of any such termination or change as required by law.
